By accessing or using MotionGen ("the Service"), you agree to be bound by these Terms of Service. Please read them carefully before using the platform.

1. Eligibility

You must be at least 18 years old to use MotionGen. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these terms.

2. Account Responsibilities

• —You are responsible for maintaining the security of your account credentials
• —You must not share your account or allow others to access it
• —You are responsible for all activity that occurs under your account
• —You must notify us immediately of any unauthorized account use

3. Credits and Payments

MotionGen operates on a credit-based system. Credits are purchased in packs and are non-refundable except where required by law.

• —Credits are deducted upon successful video generation
• —Credits do not expire and have no cash value
• —If a generation fails due to a platform error, credits are automatically refunded
• —Prices are listed in USD and are subject to change with notice

4. Acceptable Use

You agree not to use the Service to generate content that:

• —Is illegal, harmful, threatening, or harassing
• —Depicts minors in a sexual context
• —Constitutes non-consensual intimate imagery or deepfakes of real individuals without consent
• —Infringes on intellectual property rights of third parties
• —Is designed to spread disinformation or manipulate public opinion
• —Violates any applicable laws or regulations

Violation of these rules may result in immediate account termination and forfeiture of remaining credits.

5. Intellectual Property

You retain ownership of the prompts you submit and the videos generated using your account, subject to the licenses granted herein.

By publishing a video to the public Gallery, you grant MotionGen a non-exclusive, royalty-free license to display and promote that content on the platform. You can revoke this license at any time by removing the video from the Gallery.

6. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may suspend the Service for maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from downtime.

7. Limitation of Liability

To the maximum extent permitted by law, MotionGen and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, even if advised of the possibility of such damages.

8. Termination

You may close your account at any time from the profile menu. We may suspend or terminate accounts that violate these terms without prior notice.

Upon termination, your right to use the Service ceases and your credit balance is forfeited (unless termination was caused by our error).

9. Changes to Terms

We may revise these terms at any time. Material changes will be communicated via email or an in-app notice. Continued use of the Service after changes take effect constitutes your acceptance.
